By accessing, browsing, or using the VTKRO platform in any manner — including creating an account, building a website, purchasing a publishing plan, or engaging with any feature — you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you must immediately discontinue use of the Platform and refrain from creating an account or accessing any VTKRO services.

For the purposes of these Terms, the following definitions shall apply:

To use the VTKRO platform, you must meet the following eligibility criteria:

• You must be at least eighteen (18) years of age, or the age of legal majority in your jurisdiction, whichever is greater.
• If you are under the age of 18, you may only use the Platform under the supervision and with the consent of a parent or legal guardian who agrees to be bound by these Terms.
• You must have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872.
• You must not be barred from using the Platform under any applicable law.
• If you are registering on behalf of a business entity, you represent and warrant that you have the authority to bind that entity to these Terms.
• You must provide accurate, current, and complete information during registration.

To access certain features of the Platform, you must create an account ("Account"). During registration, you agree to:

• Provide accurate, truthful, and complete registration information, including your full name, email address, phone number, and business details.
• Create only one (1) account per person or business entity. Duplicate accounts may be merged or terminated at VTKRO's sole discretion.
• Choose a strong password and maintain the confidentiality of your Account credentials. You are solely responsible for all activities under your Account.
• Immediately notify VTKRO at support@vtkro.com if you become aware of any unauthorized use of your Account.
• Accept full responsibility for any and all actions, transactions, and content associated with your Account.
• Not share, transfer, sell, or assign your Account to any third party without prior written consent from VTKRO.

VTKRO reserves the right to suspend or terminate any Account found to contain inaccurate information or used in violation of these Terms.

VTKRO provides a comprehensive website builder SaaS platform designed for local businesses in India. Our services include:

VTKRO operates on a freemium model: creating a website is free, and you only pay when you choose to publish it live.

Due to the digital nature of our services and the immediate resources allocated upon payment, our refund policy is as follows:

• Publishing Fees are generally non-refundable once your Website has been successfully published.
• If your Website fails to go live due to a technical error on VTKRO's end, a full refund will be processed within 7-10 business days.
• If VTKRO is unable to resolve a significant technical issue within 14 business days, you may be eligible for a refund at VTKRO's sole discretion.
• Refund requests must be submitted within 7 days of payment by contacting support@vtkro.com.
• Refunds, if approved, will be processed to the original payment method within 7-10 business days.
• VTKRO reserves the right to deny refund requests that are found to be fraudulent or made in bad faith.

As a User of the VTKRO platform, you are responsible for:

• Ensuring that all information you provide to VTKRO is accurate, truthful, current, and complete.
• Ensuring that all Content you upload, display, or publish does not violate any applicable law or third-party rights.
• Maintaining the security and confidentiality of your Account credentials.
• Using the Platform only for building and publishing legitimate business websites.
• Complying with all applicable laws including the Information Technology Act, 2000, Consumer Protection Act, 2019, and DPDP Act, 2023.
• Regularly reviewing and updating your Website content to ensure accuracy and compliance.

You agree NOT to use the VTKRO platform to create, publish, host, or distribute content that is:

You retain ownership of all Content you upload. By uploading Content, you grant VTKRO a limited license to display, store, and cache your Content for providing the Services.

You represent and warrant that:

• You own or have the necessary licenses, rights, and permissions to use all Content you upload.
• Your Content does not infringe the intellectual property rights or privacy rights of any third party.
• Your Content does not contain any material that is unlawful, defamatory, obscene, or harmful.

VTKRO offers AI-powered features to assist in building your Website.

• VTKRO provides cloud hosting for all Published Websites. No guaranteed uptime is made for standard plans.
• Scheduled maintenance may cause temporary unavailability. VTKRO will provide advance notice when possible.
• VTKRO is not liable for downtime, data loss, or service interruptions beyond its reasonable control.
• VTKRO employs industry-standard backup procedures but does not guarantee backup availability.
• VTKRO reserves the right to impose resource limits to ensure platform stability.

The VTKRO platform integrates with various third-party services including payment gateways, Cloudinary, cloud hosting providers, email services, analytics tools, AI service providers, and CDN providers.

These third-party services are subject to their own terms and privacy policies. VTKRO is not responsible for the availability, accuracy, or practices of third-party services.

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy.

• We collect only the information necessary to provide our Services effectively.
• We do not sell your personal data to third parties.
• We implement industry-standard security measures to protect your data.
• We comply with the DPDP Act, 2023 and the IT Act, 2000.
• You have the right to access, correct, and request deletion of your personal data.

To the maximum extent permitted by applicable law, VTKRO shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Any damages resulting from your access to or use of, or inability to access or use, the Platform.
• Any loss or damage arising from viruses, malware, or other malicious content.
• Any interruption, suspension, or termination of the Platform.

VTKRO's total aggregate liability shall not exceed the greater of: (a) the total amount paid by you in the twelve (12) months preceding the event; or (b) INR 1,000.

The VTKRO platform and all services are offered on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, whether express, implied, or statutory.

VTKRO expressly disclaims all warranties including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, timely, secure, or error-free.

You agree to indemnify, defend, and hold harmless VTKRO, its directors, officers, employees, partners, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of:

• Your access to or use of the Platform.
• Your violation of these Terms.
• Your Content, including any Content that infringes the rights of a third party.
• Your use of any third-party services accessed through the Platform.
• Any activity related to your Account.
• Your violation of any applicable law or regulation.

• Active Account Data: Retained while your Account is active.
• Deleted Account Data: 30-day grace period, then permanently deleted from active systems.
• Backup Data: May persist up to 90 days after deletion.
• Published Website Data: Removed within 24 hours of Account deletion.
• Tax & Invoice Records: Retained for 7 years as required by Indian tax law.
• Agent/KYC Data: Retained for 5 years after termination of the Agent relationship.
• Anonymized/Aggregated Data: May be retained indefinitely.

As a limited promotional offer, the first 2,000 paying users receive lifetime access:

• Lifetime access means your Website remains live for as long as VTKRO operates.
• Limited to the first 2,000 paying customers on a first-come basis.
• Applies to the specific Website published during the promotional period.
• VTKRO may modify hosting infrastructure provided the Website remains functional.
• If VTKRO ceases operations, lifetime access terminates. Reasonable efforts for advance notice will be made.
• Lifetime access is non-transferable and tied to the original Account.
• VTKRO reserves the right to impose fair usage limits.
• This offer may be discontinued for new users at any time without affecting existing holders.

• Each Published Website is subject to fair usage limits as displayed at purchase or on the Pricing page.
• Storage limits apply to all uploaded media including images, videos, and documents.
• Bandwidth limits apply to total data transferred to visitors.
• Exceeding limits may result in throttling, restricted access, or required upgrade.
• VTKRO reserves the right to modify limits with 30 days advance notice.
• Users are responsible for monitoring usage through the dashboard.
• Excessive or abusive usage may result in enforcement actions.

All templates are the intellectual property of VTKRO or its licensors. By using a template:

• The license is non-exclusive, non-transferable, and revocable.
• You may customize templates to suit your business needs.
• You may not reverse engineer, decompile, or extract template code for use outside VTKRO.
• You may not resell, redistribute, or sublicense any template or component.
• Template designs are provided as-is with no guarantees of specific outcomes.

VTKRO reserves the right to modify these Terms at any time:

• Material changes will be notified via email and/or Platform notice at least 14 days before taking effect.
• Updated Terms will be posted on this page with a revised "Last Updated" date.
• Non-material changes may be posted without advance notice.
• Continued use after changes constitutes acceptance.
• If you do not agree, you must stop using the Platform and delete your Account.

These Terms are governed by the laws of India, specifically:

• Indian Contract Act, 1872 — governing the contractual relationship
• Information Technology Act, 2000 — governing electronic transactions and cybercrimes
• Digital Personal Data Protection Act, 2023 — governing data protection
• Consumer Protection Act, 2019 — governing consumer rights
• Goods and Services Tax Act, 2017 — governing taxation

If you access the Platform from outside India, you are responsible for compliance with local applicable laws.

VTKRO offers an Agent & Affiliate Program for earning commissions by referring customers:

• Agent registration is subject to KYC verification and approval.
• Commissions are earned only on successful, verified referrals.
• VTKRO reserves the right to withhold commissions for suspected fraud or violations.
• Full terms are available in the separate Agent Agreement upon registration.
• VTKRO reserves the right to modify commission rates or terminate the program with 30 days notice.

VTKRO shall not be liable for failure or delay resulting from events beyond reasonable control, including:

• Natural disasters, epidemics, pandemics
• War, armed conflict, terrorism, government sanctions
• Government actions or orders restricting operations
• Internet service provider failures or network outages
• Power grid failures or prolonged outages
• Cyberattacks including DDoS and ransomware
• Fire, explosion, or structural damage
• Labor strikes or disputes
• Failure of third-party services

VTKRO will make reasonable efforts to mitigate impact and resume operations promptly.
